General Counsel - (190002W0) Description **The General Counsel requisition is internal to Massachusetts Rehabilitation Commission employees only.** Massachusetts Rehabilitation Commission is seeking a highly motivated and experienced attorney for the role of GENERAL COUNSEL. The selected applicant will provide guidance and counsel to the senior leadership team and the Commissioner of Massachusetts Rehabilitation Commission (MRC), while advising the agency on a broad range of legal matters affecting the day-to-day operations. The successful candidate will ensure legal conformity and minimize probability of risk exposure to the agency while providing effective managerial leadership, good judgment and the ability to guide the organization through many legal, statutory and regulatory matters. Duties and Responsibilities (these duties are a general summary and not all inclusive): * Manage and advise senior management and agency staff with respect to legal matters by interpreting laws, rules, regulations, and decisions of the agency; * The General Counsel participates in the formulation and review of agency strategic planning and policy across each of the agency's three divisions; * The General Counsel works directly with the agency head, deputy commissioners, CFO and program managers on the development of annual programmatic and operational state budget recommendations. * Oversee all aspects of Administrative Appeals process including denials, terminations and review of decisions for MRC programs throughout the Commonwealth;* Propose and draft agency regulations, directives and contracts for conformity with applicable state, federal and local laws and regulations; Conduct legal research and prepare legal opinions; * Collaborate and maintain relationships with other governmental agencies and their legal staffs through consultation and negotiation to develop memoranda/agreement on joint programs; * Represent the agency at administrative hearings, including, but not limited to, the Massachusetts Commission against Discrimination, the Division of Administrative Law Appeals, Attorney General and the Civil Service Commission; * Review estate matters, tort law and other claims to obtain information and engage in settlement discussions; Consults with General Counsel of the Executive Office of Health and Human Services regarding appeals of judicial decisions; * Assess situations to determine the importance, urgency and risks, and make clear decisions which are timely and in the best interests of the agency; * Participate in daily or weekly management team meetings to discuss legal matters, updates, and other concerns or issues; * Manage the efficient and effective operation of the Agency's Legal Department. Advise, supervise and direct staff. Oversee all Administrative functions of the department. Supervise Counsel staff, Provide leadership, well-reasoned legal guidance and best practices to staff; Requirements: * Juris Doctor (JD) or Bachelor of Law Degree from an American Bar Association (ABA) accredited law school; * Admission to practice in the Commonwealth of Massachusetts and member in good standing of the bar. Preferred Qualifications: * Knowledge of the principles and practices of state and federal laws, rules and regulations, pertaining to individuals with disabilities, litigation, and administrative practice; previous government experience desired; * Proven skills in legal problem analysis and resolution through the practice of law, corporate attorney or other relevant role as attorney; * Managing a team of direct reports; empowered management in engaging and developing teams; * Track record of excellent judgment, integrity, honesty, discretion, and business acumen; * Strong sense of urgency and commitment to deadlines, attention to detail, and the ability and desire to handle increasing levels of responsibility; * Demonstrated success in working with multidisciplinary teams; maintaining working relationships with other administrative officials, and regulatory agency staff; * Skilled in effectively presenting information in one-on-one and diverse group situations; * Competence in resolving problems/conflicts in a diplomatic and tactful manner; exercising discretion in handling confidential information; * Thoroughness, independence and excellent written and oral communication skills; * Proficient usage of Microsoft Office products including Word, Excel, PowerPoint and Outlook.
