Counsel II - Boston - (190004N2)
Description
Duties:
The Massachusetts Department of Correction has immediate openings for two staff attorneys (Counsel II) in its Boston Legal Office. These attorneys will be responsible for handling active inmate civil rights litigation in the state and federal courts involving constitutional issues, conditions of confinement, medical care, complex class actions and systems litigation, and will provide in-house counsel on a variety of matters as required. Extensive trial and appellate experience in civil litigation is required. Litigation duties include travel to state correctional facilities and state and federal courts located throughout the Commonwealth.
These positions are required to help shoulder the Department of Correction Legal Division's heavy litigation workload. The cases involve multiple day jury and non-jury trials, hearings, and labor-intensive discovery. The attorneys will be responsible for conducting jury and non-jury trials as well as motion hearings before any of the Commonwealth's state courts, the Massachusetts Appeals Court, the Supreme Judicial Court, Federal District Courts, the First Circuit Court of Appeals, with the vast majority of cases filed in Boston or in contiguous counties. In addition, these attorneys are responsible for interviewing witnesses at 16 state correctional institutions and gathering relevant institutional records; consulting with other DOC staff and legal representatives and parties involved; reviewing case files, transcripts of prior hearings, administrative decisions, and other records of case proceedings; defending clients at depositions; conducting legal research; preparing motions, legal
briefs, and memoranda of law. Also responsible for providing legal advice as in-house counsel to all DOC employees, to include the interpretation of applicable laws, regulations and case decisions impacting DOC. Perform other duties as assigned.
Special Requirements:
Possession of a current and valid Massachusetts Class 3 Motor Vehicle Operator's License is required.
Preferred Qualifications:
The ideal candidate for each position will be an experienced trial attorney, with significant appellate experience as well. Candidates should have excellent academic backgrounds, the ability to communicate effectively both orally and in writing, and a minimum of two (2) years litigation experience. Experience in criminal justice experience is strongly preferred.

This is a Civil Service position. Please note that salaries for union positions are determined according to the provisions of the respective collective bargaining agreement.

The agency shall consider any incidents of sexual harassment in determining whether to hire anyone who may have contact with offenders or residents.

MINIMUM ENTRANCE REQUIREMENTS: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.
Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
